My brother got arrested in NYC last night for carrying a Benchmade AFCK tactical folder knife. He was not being belligerent or wielding it, or generally being stupid. He was walking to get sushi and a undercover officer approached him and asked if that was a knife clip on his pocket. He said it was and that it was a legal knife to carry, witch it is. He was told it was an illegal gravity knife and arrested. He was never read his rights and has been in central booking without seeing a judge or eating for 16 hrs now. Is there anything I can do? What is my next course of action? Also, he has long hair and looks like a bad ass, but he isn't. He's very smart and a friendly guy. Thanks for any help you can give me.
It's common now for police to not read you your rights.
They should inform him of his rights before seeing a judge.
Unless the knife is plainly visible he could be charged with carrying a concealed weapon if its more than a three inch blade.
It's a grey area left to interpretation as to the type of knife weather it's legal or not.
Bottom line he's caught a case and will need a lawyer.
As for him being in jail, there is nothing that can be done until he see's a judge.
Then he should get a bail.
Bail him out and bring food.
He will need a good lawyer too.
